What is a letter of resignation?
A letter of resignation is a formal written notice from an employee to their employer stating their intention to leave, the proposed last working day, and (optionally) a brief reason. In the UK, it activates the statutory notice period defined by the Employment Rights Act 1996 — a minimum of one week after one month's continuous service, rising to longer contractual periods set out in your written statement of employment particulars.
UK essentials: what every letter must contain
Whatever your sector, a compliant UK resignation letter must include six elements. Miss any one of these and you risk disputes over notice, pay, or references.
- Date in DD/MM/YYYY format (e.g. 15/03/2026)
- Recipient — line manager or HR, addressed by name where possible
- Clear statement of resignation — "I am writing to formally resign from my position as…"
- Last working day — calculated from your contractual notice period
- Brief, neutral reason (optional) — "to pursue a new opportunity" is sufficient

Resigning during probation: shorter notice rules
If you are still inside your probation period — typically the first three to six months of a new job — your notice obligations are usually much shorter than in your main contract. Most UK contracts specify a probationary notice of one week (sometimes as little as one day for hourly roles), and statutory law backs this up: under the Employment Rights Act 1996, no statutory notice is owed at all in the first month of service.
Three points to check before sending your letter during probation:
- Your written statement of particulars — section on probation will state the exact notice (commonly "one week during probation, one month thereafter").
- Accrued holiday — even after only a few weeks, you accrue 5.6 weeks' statutory leave pro-rata under the Working Time Regulations 1998. It must be paid out.
- Reference rights — short-service references are still customary in the UK, even if you only worked for six weeks. Always ask in writing.
The letter itself can be very brief. Example:

Garden leave vs PILON (pay in lieu of notice)
Once your letter is in, your employer has three choices: have you work your notice, place you on garden leave, or invoke a PILON (pay in lieu of notice) clause. Each has different implications for pay, restrictive covenants and your start date with a new employer.
Garden leave
You remain employed and continue to receive full salary, pension contributions and benefits, but you are told to stay at home and not contact clients or colleagues. Garden leave is common in finance, law and senior tech roles where the employer wants to keep you out of the market. Crucially, your restrictive covenants (non-compete, non-solicit) keep running during this period — which can delay your new job start. Check your contract: garden leave is only enforceable if the contract permits it.
Pay in lieu of notice (PILON)
If your contract contains a PILON clause, your employer can terminate immediately and pay your notice as a lump sum. Since April 2018, PILON payments are fully taxable as earnings (subject to PAYE and NI) under the Post-Employment Notice Pay (PENP) rules, regardless of whether the clause is contractual. The upside: you can start a new job sooner. The downside: you may lose share-vesting or bonus accrual that would have continued during a worked notice period.
Working your notice
The default. You work to your stated last day, hand over properly, and take any remaining holiday or have it paid out. This is usually best for protecting your reference and any deferred compensation.
In your resignation letter, it's reasonable to ask which option the employer intends to apply — particularly if you have a competing offer with a fixed start date.
Can you retract a resignation? The Sothern v Franks Charlesly rule
Once a resignation has been clearly given, you generally cannot withdraw it without the employer's consent. The leading authority is Sothern v Franks Charlesly & Co [1981] IRLR 278, in which the Court of Appeal held that unambiguous words of resignation take effect when communicated — the employer is entitled to rely on them and is not obliged to allow a change of mind.
There are two narrow exceptions courts and tribunals have recognised since:
- Words spoken in the heat of the moment — for example a resignation shouted during a row. Tribunals (following Kwik-Fit v Lineham [1992] ICR 183) expect employers to allow a short cooling-off period before treating such words as a real resignation.
- Special circumstances — where the employee was clearly distressed, unwell, or under undue pressure when resigning.
Outside these exceptions, if you change your mind you must ask — politely and quickly — and the employer can refuse. The safest course is to never send the letter until you are certain. If you do want to withdraw, do so in writing the same day and ask Acas or Citizens Advice for guidance.
Constructive dismissal: when NOT to resign without Acas advice
Important: if you are resigning because of your employer's conduct — bullying, unpaid wages, a unilateral demotion, a fundamental breach of your contract, or a failure to address a serious grievance — do not send a standard resignation letter without first contacting Acas. Sending the wrong type of letter can permanently undermine a constructive dismissal claim at an Employment Tribunal.
Constructive dismissal (Section 95(1)(c) Employment Rights Act 1996) requires you to show that:
- Your employer committed a fundamental breach of your contract (express or implied);
- You resigned in response to that breach;
- You did not delay resigning, otherwise you may be treated as having accepted the breach.
Warning signs that you may be in constructive dismissal territory:
- Sustained bullying, harassment or discrimination under the Equality Act 2010 that HR has failed to address;
- Unilateral cut to pay, hours, location or role grading without agreement;
- Persistent non-payment of wages, expenses, or contractual bonus;
- Breakdown of the implied duty of mutual trust and confidence.
Before writing anything, call the free Acas helpline on 0300 123 1100 (Mon-Fri 08:00-18:00) and consider notifying Acas Early Conciliation — a mandatory step before lodging a tribunal claim.
